Erie County Real Estate Transactions July 2019: An Update on the Court's Procedures

As we navigate the current situation, the Erie County court is taking necessary measures to ensure the safety and well-being of everyone involved. In this article, we will provide an update on the court's procedures regarding real estate transactions in July 2019.

Civil Actions and Jurisdiction

The court has jurisdiction over civil actions such as those for the recovery of property, contract disputes, interpleader, replevin, forcible entry and detainer, to satisfy judgments, personal property sales, and foreclosure of liens. Additionally, the court has jurisdiction in cases where the amount to be recovered does not exceed Fifteen Thousand Dollars ($15,000).

Territorial Jurisdiction

The court's territorial jurisdiction covers the city of Sheffield Lake and Sheffield Township as well as that of the city of Lorain.

Preliminary Hearings and Felony Cases

--------------------------------

The court has jurisdiction to hold preliminary hearings in felony cases committed in Lorain and to discharge, recognize or commit the accused. This includes cases involving violations of any ordinance of the city of Lorain or misdemeanor offenses committed within the city's limits.

New Process for Arraignments

As part of its efforts to ensure public safety, the court will begin implementing a new process for arraignments starting November 30, 2020. Arraignments for new cases will be conducted virtually, with the goal of having all arraignments heard remotely by December 7, 2020.

Payment Options and Drop Box

------------------------

The Clerk of Courts office has added three new call-in 'payment hotlines' to accommodate those wishing to pay by phone. Additionally, a drop box will be installed outside the main entrance of City Hall for payment of fines during normal business hours.

Civil Cases and Traffic Offenses

Individuals with Civil cases or intending to file a Civil case can inquire with the Clerk of Courts at (440) 204-2140 OPTION 2. Traffic offenders still have the option to waive their tickets by calling (440) 204-2847 or online.

Bonding and Jail Releases

If anyone wishes to bond an individual out of jail, they can call (440) 204-2840 between 8:30 am and 4:30 pm to schedule an appointment. After-hours bonding is also available through any bondsperson that has previously registered with the Clerk of Court's Office.
